Welcome to Next Vibe AI. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Next Vibe AI ("Company," "we," "us," or "our").

By accessing our website, exploring our AI tools directory, utilizing our AI SaaS APIs, or subscribing to our credit plans, you agree to be bound by these Terms. If you do not agree, please discontinue using our services immediately.

1. Acceptance and Modification of Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material updates by revising the "lastUpdated" timestamp above or sending notification via email. Your continued use of the platform following any modifications signifies your acceptance of the updated Terms.

2. Account Registration and Security

2.1 Account Eligibility

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to register an account. By creating an account, you represent that all information provided is accurate and complete.

2.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials, tokens, and sessions. You accept full responsibility for all activities occurring under your account. Notify us immediately at support@nextvibeai.uk if you suspect unauthorized access.

3. Acceptable Use and Restrictions

When using Next Vibe AI, you agree NOT to:

  • Violate any applicable local, national, or international laws or regulations.
  • Reverse engineer, decompile, or attempt to extract source code from non-open-source platform components.
  • Use automated scraping, bots, or data mining tools on our directory without prior written authorization.
  • Input malicious code, prompt injection attacks, or content that promotes illegal acts, harassment, or hate speech into AI models.
  • Attempt to bypass subscription paywalls, rate limits, or credit billing checks.

4. AI Services & Generated Content Rights

4.1 AI Outputs

Next Vibe AI integrates Vercel AI SDK and multi-model providers to process prompts and generate outputs (e.g., text, code, analysis).

4.2 Ownership of Content

  • User Ownership: As between you and Next Vibe AI, you retain all ownership and intellectual property rights in your original input prompts and the generated AI outputs, subject to applicable law.
  • Responsibility: You are solely responsible for reviewing the accuracy, appropriateness, and copyright compliance of AI-generated content before publishing or using it in commercial environments.

5. Subscriptions, Payments & Credit Policy

5.1 Pricing and Credits

Access to premium AI models, priority generation, or submission features may require recurring subscriptions or credit package purchases. Prices and credit allocation terms are detailed on our Pricing Page.

5.2 Billing & Payments

Payments are processed via authorized third-party gateways (Stripe, PayPal, WeChat Pay, Alipay). By subscribing, you authorize automatic recurring charges until you cancel your subscription.

5.3 Refund Policy

Due to the digital nature of AI compute credits and instant resource access, all purchases are generally non-refundable, except where required by mandatory applicable consumer laws or in cases of platform service unavailability exceeding SLA thresholds.

6. Intellectual Property Rights

The Next Vibe AI platform name, logo, UI/UX designs, branding assets, documentation, and proprietary software are owned exclusively by Next Vibe AI and protected by international intellectual property laws. Open-source components provided under the Apache License 2.0 remain governed by their respective licenses.

7. Disclaimers and Limitation of Liability

7.1 "As-Is" Service

NEXT VIBE AI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXT VIBE AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES) ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE PLATFORM.

8. Termination

We reserve the right to suspend or terminate your account and access to our services immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or violate system security boundaries.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation, failing which it shall be submitted to binding arbitration.
